1. Agreement
These Terms and Conditions are an agreement between you and OrvexaCo for the Android app Petalgrove (the App). By installing or using the App, you agree to these Terms. If you do not agree, do not use the App. If you are a parent or guardian, you accept these Terms on behalf of any child who uses the App on your device.
2. Personal licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Android devices you own or control, for your own entertainment. You may not copy, resell, redistribute, reverse-engineer or create derivative works from the App, except where the law expressly permits.
3. Free to play
The App is free to download and play. It has no ads and no subscriptions. Gameplay never requires a purchase: every level, garden area and feature can be reached by playing. Optional in-app purchases are described in section 4.
4. In-app purchases
- Gem and coin packs. You can optionally buy packs of gems or coins. They are consumable: they are added to your in-game balance and used up as you spend them. Packs are one-time purchases, not subscriptions, and do not renew.
- Payment. All purchases are processed by Google Play under your Google account and the Google Play Terms of Service. We never see your payment details. Purchases are validated with our service provider RevenueCat, Inc., as described in the Privacy Policy.
- Prices. Prices are shown by Google Play in your local currency before you confirm a purchase, and may include taxes that apply where you live. We may change prices in future; a change does not affect purchases you have already made.
- Final sales and refunds. All sales of virtual items are final once the items are credited, except where the law or Google Play's refund policy requires otherwise. Refunds are requested and handled through Google Play. If a purchase is charged but not credited, contact us with your Google Play order number.
- Parents. Parents and guardians should control purchases on their child's device using Google Play's purchase authentication and family settings.
5. Virtual items
- Coins, gems, stars, event tokens, boosters and other in-game items are earned by playing or, for gems and coins, bought as described in section 4, and are spent inside the App.
- Virtual items are licensed to you for use in the App only. They have no cash or monetary value, cannot be sold, transferred to another person or account, or exchanged for money or anything outside the App.
- Virtual items are stored on your device with the rest of your progress. If the App's data is deleted, they may be lost, and consumable purchases that have been credited cannot be restored.
6. Levels, garden and events
- Levels, garden areas, pets, the market-day mini-game, daily gifts, daily challenges, weekly events and achievements are part of the App and may change over time.
- Daily gifts, daily challenges and weekly events follow your device's date. Changing the date may affect them.
- The characters Aunt Marigold, Wren, Basil and Juniper and the pets are fictional characters built into the App. They are not real people or animals.
7. Offline play and your progress
Gameplay works fully offline, and your progress is stored only on your device. You are responsible for keeping it. Uninstalling the App, using Settings, Reset progress, clearing the App's data or losing your device can permanently remove your progress and virtual items, including purchased gems and coins, and we cannot recover them for you. Android's own device backup may keep a copy if you have turned it on, but that is controlled by your device and Google account settings, and we do not guarantee that progress can be restored from it.
8. Acceptable use
- Use the App only for lawful, personal entertainment.
- Do not interfere with the App or its intended operation, tamper with its files, or modify it to unlock content or change your balance of virtual items.
- Do not exploit bugs or use unauthorised tools to gain items, or attempt to get around Google Play's purchase process.
- Do not use the App, its artwork or its content to make, sell or distribute another product.
9. Privacy
The App does not require an account, and gameplay works fully offline. In-app purchases need an internet connection and use Google Play and RevenueCat. The App's data practices are described in the Privacy Policy, which forms part of these Terms.
10. Intellectual property
The App, including its name, logo, story, characters, pets, garden areas, original artwork, sounds, levels and game design, is original content that belongs to OrvexaCo or its licensors. Match-3 puzzles are a familiar game genre; these Terms cover our implementation and presentation of it. Open-source components remain under their own licences.
11. Updates and availability
We may update, change or discontinue the App or any feature at any time. When the App is installed from Google Play, updates are offered and delivered through Google Play. We aim to keep your saved progress when updating, but we do not guarantee it.
12. Disclaimer and limitation of liability
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. To the fullest extent permitted by law, OrvexaCo will not be liable for indirect, incidental, special or consequential damages, or for loss of progress, virtual items or data, arising from use of the App. Some jurisdictions do not allow certain limitations, so these may not apply to you.
13. Termination
You may stop using the App at any time by uninstalling it. Your licence ends if you breach these Terms. Sections concerning the licence, purchases, virtual items, acceptable use, intellectual property, disclaimer and contact survive termination.
14. Governing law
These Terms are governed by applicable local law. Disputes are resolved in the courts of competent jurisdiction at our principal place of business unless otherwise required. Nothing in these Terms limits rights you have under the consumer-protection laws of the country you live in.
15. Changes
We may update these Terms. We will change the effective date when we do. Continuing to use the App after a change means you accept the updated Terms.
