1. Agreement
These Terms and Conditions are an agreement between you and OrvexaCo for the Android app XO Arena (the App). By installing or using the App, you agree to these Terms. If you do not agree, do not use the App. If you are a parent or guardian, you accept these Terms on behalf of any child who uses the App on your device.
2. Personal licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Android devices you own or control, for your own entertainment. You may not copy, resell, redistribute, reverse-engineer or create derivative works from the App, except where the law expressly permits.
3. Free to play
The App is free to download and play. It has no ads and no subscriptions. Every game mode, level, opponent, season and daily challenge is available without payment. Optional in-app purchases are described in section 4.
4. In-app purchases
- Cosmetic packs. The Neon Pack, Boards Pack and Symbols Pack are optional one-time purchases that unlock extra cosmetic themes, boards or symbols. They do not change gameplay or give any advantage. Each pack is tied to the Google account you used to buy it, and you can restore it on a new or reset device with "Restore purchases" in the App while signed in to Google Play with that account.
- Tips. Tips are voluntary payments to support the development of the App. They grant no extra content, features or advantages, and they cannot be restored or transferred.
- Payment. All purchases are processed by Google Play under your Google account and the Google Play Terms of Service. We never see your payment details.
- Prices. Prices are shown in the store in your local currency before you confirm a purchase, and may include taxes that apply where you live. We may change prices in future; a change does not affect purchases you have already made.
- Refunds. Refunds follow Google Play's refund policy and are requested through Google Play. If a pack purchase is refunded, the pack may be removed from the App.
- Purchased content is licensed to you for use in the App only. It has no monetary value and cannot be sold, exchanged for money or transferred to another account.
5. Games and opponents
- The App includes Classic 3×3, 4×4, 5×5 (four or five in a row), Misère, Misère 4×4, Timed and Ultimate Tic Tac Toe. Game modes and rules may change between versions.
- The AI opponents Pip, Vex and Nova are computer players built into the App. They are not real people.
- Local two-player mode is played by two people on one device. No data is exchanged with other devices.
6. Levels, seasons and rewards
- Levels, seasons, daily challenges, achievements and rewards are part of the App and may change over time.
- Season rewards and other items unlocked through play are cosmetic. They have no monetary value, cannot be bought, sold or exchanged for money, and exist only inside the App.
- Daily challenges and monthly seasons follow your device's date. Changing the date may affect them.
7. Your progress
Your progress is stored on your device. You are responsible for keeping it. Uninstalling the App, using Settings, Reset statistics, clearing the App's data or losing your device can permanently remove your progress, and we cannot recover it for you.
8. Acceptable use
- Use the App only for lawful, personal entertainment.
- Do not choose player names that are offensive, hateful or that impersonate another person, especially when playing with others on a shared device.
- Do not interfere with the App or its intended operation, tamper with its files, or modify it to unlock content.
- Do not use the App, its artwork or its content to make, sell or distribute another product.
9. Statistics
Statistics, levels and match history in the App describe gameplay only. They are not medical, psychological or cognitive assessments.
10. Privacy
The App does not require an account, and gameplay works fully offline. In-app purchases need an internet connection and use Google Play and RevenueCat. The App's data practices are described in the Privacy Policy, which forms part of these Terms.
11. Intellectual property
The App, including its name, logo, original artwork, boards, symbols, AI opponent characters, sounds and game design, belongs to OrvexaCo or its licensors. Tic Tac Toe and its classic variants are traditional games; these Terms cover our implementation and presentation of them. Open-source components remain under their own licences: the fonts Lilita One and Nunito under the SIL Open Font License, and icons under the Apache License 2.0.
12. Updates and availability
We may update, change or discontinue the App or any feature at any time. When the App is installed from Google Play, updates are offered and delivered through Google Play. We aim to keep your saved progress when updating, but we do not guarantee it.
13. Disclaimer and limitation of liability
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. To the fullest extent permitted by law, OrvexaCo will not be liable for indirect, incidental, special or consequential damages, or for loss of progress or data, arising from use of the App. Some jurisdictions do not allow certain limitations, so these may not apply to you.
14. Termination
You may stop using the App at any time by uninstalling it. Your licence ends if you breach these Terms. Sections concerning the licence, acceptable use, intellectual property, disclaimer and contact survive termination.
15. Governing law
These Terms are governed by applicable local law. Disputes are resolved in the courts of competent jurisdiction at our principal place of business unless otherwise required. Nothing in these Terms limits rights you have under the consumer-protection laws of the country you live in.
16. Changes
We may update these Terms. We will change the effective date when we do. Continuing to use the App after a change means you accept the updated Terms.
